1. INTRODUCTION AND ACCEPTANCE OF TERMS
1.1. The www.halalholidays.asia site (“site”) is patent, copyright and trademark, owned and managed by Tahira Asia Sdn Bhd (“we”, “us”, “our”, “Halal Holidays” or “Tahira Asia”). These terms and conditions (“Terms”) guide and govern the usage of the Site and the services available and offered on this platform, through it. Once you access this website, these Terms are deemed obligated and constitute a binding legal agreement between you as a user (“you”,“your”, or “users”) and Halal Holidays. We assume that you are at least eighteen (18) years old, from date of being delivered, to qualify usage of this website.
1.2. By accessing and/or using any part of the Site, you acknowledge that you have read and understood, and agree to the Terms of Use (“Terms”) and other supplemental terms and conditions in relation to the Site as referred to in these Terms. If you do not agree to be bound by these Terms, you may not access or use any part of the Site.
1.3. Please note that we may modify, add, and/or retrieve these Terms at any time where this is necessary to comply with any law or regulation binding on us or to reflect a change to our operational practices.
1.4. Please check these Terms each time you use the Site to confirm that you have reviewed the most recent version. By continuing to use any aspect of the Site following such changes to these Terms, you thus agree and consent to the changes and its application to you.
2. SCOPE OF OUR SERVICE
2.1. Tahira Asia Sdn Bhd provides an online platform through www.halalholidays.asia for users to browse travel packages, experiences and tours, and/or other services (“Services”). Users are able to make bookings of services provided by travel agencies.
2.2. We will update and collate contemporary data relevant for the usage of this website, but though we endeavor to get updated data, we caution all users, in performing the Services, we do not verify, and do not guarantee, that all information provided by direct and third party, Vendors, on data that is available on the Site, is accurate, complete, correct or the latest available, and we redeem and indemnify ourselves for any errors (including placement and typing errors), obstruction (either because of temporary and/or partial, damage, repair or improvement to the Site. In the event of any consequential data which are inaccurate, misleading or false information of/by Vendors or non-delivery of information of/by Vendors, we advise users to alert and notify us urgently for immediate authenticated data to be revert and given.
2.3. Changes in market conditions or circumstances that occur can lead to changes in a short time causing the information provided by Vendors that is available on the Site to be inaccurate or not applicable. In case of any problems, please contact our Customer Service and they will assist you.
2.4. Halal Holidays platform serves as an intermediary between Users and Vendors. We do not own or operate any of the services offered. To the extent permitted by law, we are not responsible or liable for the acts or omissions of a Vendor. You are therefore advised to be very cautious as you have sole responsibility for any obligations or liabilities to Vendors.
2.5. We do not represent, and our data should not be construed as making any recommendations or suggestions of the level of service quality or rating of the Vendors listed on the Site. In no event shall we be responsible or liable for any information, content, products, services or other materials provided or made available by Vendors.
2.6. To the extent permitted by law, we have the right to not accept any user or booking (or in certain cases cancel the booking confirmation) at our sole and absolute discretion and for any cause and we have the right for any reasons whatsoever for not giving reasons for the rejection/refusal/cancellation.
2.7. Reasons for rejecting a user or booking, or canceling a booking confirmation, include but are not limited to breaching these Terms, trade or economic sanctions, embargoes, regulatory prohibitions, fraud or theft (or suspicion thereof), suspicion of criminal activity, suspicious ordering, service unavailability, providing inaccurate or misleading information, credit card issues, inappropriate behavior, threats, insults, refusal to provide information, practical impediments, communication difficulties, a Real Mistake (described below), past breaches of these Terms, or being listed on government or international “black lists” or “watch lists.” We may delete or remove any user account, temporarily or permanently. Removed users must not use the site under any other name or through other users.
2.8. In a particular case, we may cancel or reject reservations with respect to a “Real Mistake”, which does not depend on where the error originated. A Real Mistake is unilaterally defined as a fault on the Site (for example, in terms of price) which no reasonable person would consider appropriate or to make business sense. The amount charged shall be reimbursed without further charges in such a case.
3. USER ACCOUNTS
3.1. To use the services on the site, you must create an account. During registration, we will collect and process your personal information, including your name, email address, and mobile phone number. You must provide accurate, complete, and up-to-date information and agree to provide any proof of identity we may reasonably request. We will handle your personal information in accordance with our Privacy Notice, including its collection, use, disclosure, and processing.
3.2. Only you can use your own account and you represent and warrant that you will not authorize any other party to use your identity or your account for any reason, unless permitted by Tahira Asia.
3.3. Users are not allowed to assign or transfer personal accounts to any other party.
3.4. You must maintain the security and confidentiality of your account password and any identification we provide to you. In the event of any disclosure of your password, in any way whatsoever resulting in any unauthorized use of your account or identity, order(s) received from such unauthorized use shall still be considered as valid orders and we will process such order(s). Subject to any rights you may have at law, you hereby declare that Tahira Asia is not responsible for any loss or damage arising from the misuse of your account in accordance with this clause.
3.5 If you no longer have control over your account, you are required to immediately notify us (e.g., your account is hacked in any way, or your phone is stolen) so we can temporarily block and/or inactivate your account. Please note that you are responsible for your use of your account and may be liable for your account even if your account is misused by others.
3.5.1. Tahira Asia has the full right to temporarily block, delete, or deactivate your account at our sole discretion and for any cause without giving reasons for blocking, deletion, or deactivation of your account provided that this will not affect our obligations to provide any Services that have been purchased by you prior to that time (unless we also cancel those Services as permitted by these Terms).
3.5.2. Your account may be blocked, deleted, or deactivated for various reasons, including but not limited to: breaching the terms of service, violating laws or regulations, committing fraud or theft, engaging in suspicious activities, placing suspicious orders, providing inaccurate or misleading information, behaving inappropriately, making threats or insults, refusing to provide requested information, causing practical impediments, experiencing communication difficulties or breakdowns, or being listed on government or international “black lists” or “watch lists.”

5. BOOKINGS
5.1. By placing a booking through the Site, you agree to abide by the terms and conditions of the respective Vendors, including payment terms, Vendors’ cancellation policies, refunds, and any other supplementary terms and conditions from the Vendors.
5.2. By placing an order through the Site, you will be able to book and/or purchase the travel packages, experiences and tours, or other services from the Vendors. We will provide a booking confirmation via email. We reserve the right to refuse the booking in accordance with these Terms.
6. SPECIAL REQUEST AND GROUP BOOKING
6.1. In the event of any special requests such as assistance for people with disabilities, change of date, booking modification for the tour packages or equivalent, the user can insert the request when making a booking on the Site or contact our Customer Support. The request will be based on availability and other factors. Your special requests may be subject to additional charges and/or fees.
6.2. For group bookings, where available, users must provide accurate information for all members and ensure that the group’s requirements are met. Payment terms and cancellation policies may differ from individual bookings and may require a deposit and stricter cancellation deadlines depending on the Vendor policies. Users are responsible for understanding and agreeing to these terms before confirming the reservation. Group bookings may also require additional verification and are subject to availability and specific Vendor policies. Any changes to the booking must be communicated promptly with our Customer Support, and users should be aware that modifications or cancellations may incur additional fees.
7. VISA AND TRAVEL ADVICE
7.1. By displaying specific destinations, Tahira Asia does not guarantee their advisability or safety, and is not liable for any resulting damages or losses.
7.2. Users are responsible for obtaining and maintaining necessary travel permits, including visas, as required by the laws of the countries you plan to visit. Tahira Asia does not provide notification of these requirements (unless stated otherwise) and bears no liability for any losses or damages related to travel permits.
7.3. Some travel packages offered by Vendors may include optional assistance for obtaining travel permits, which may entail additional charges or be included in the package. Tahira Asia will inform users of such arrangements at the earliest opportunity.
7.4. Users must submit required documents within specified time frames. Issuance of travel permits is subject solely to the immigration policies of the respective countries. Tahira Asia holds no responsibility for any losses or damages incurred due to travel permit issues.
8. RATING
8.1. Ratings shown on the Site are only provided for the information of users only, and existing ratings are based on information given by users. We do not verify the rating given and are therefore not responsible for the accuracy of the existing rating, nor do the ratings constitute any endorsement (or otherwise) by us. In no event shall Tahira Asia be responsible or liable for any claims, losses, or liability with respect to the ratings shown on the Site.
9. PRICE AND PROMOTION
9.1. We may offer lower prices and/ or promotions from time to time. Please note that these may involve different conditions and requirements as it relates to booking and refund policies.
10. PAYMENTS DETAILS AND PROCEDURES
10.1. All payments related to the booking of the Services shall be made directly to Tahira Asia.
10.2. Payments are made in the amount and currency as stated, including charges and designated taxes. Currently the Sales & Service Tax (SST) are designated by the Government of Malaysia.
10.3. Payment methods may include all existing methods as applied in the various countries, which may not only be limited to bank transfer and credit card. Regulated and non-regulated wallets, payment apps and other contemporary payment options may be accepted.
10.4. We may notify from time to time all acceptable payment methods.
10.5. For some bookings, users may need to pay a deposit at the time of reservation. The deposit amount and terms vary based on the type of services and policies. The specifics of the deposit and payment terms will be provided during the booking process, and users are responsible for reviewing and understanding these requirements before confirming their bookings.
10.6. Deposits may be refundable or may not be refundable, depending on the policies and terms and conditions available and unilaterally to be decided by Tahira Asia.
10.7. Any processing fees or cancellation charges will be deducted from the deposit refund amount. Some bookings may require non-refundable deposits to secure the reservation, in which case the deposit amount is forfeited if the user cancels the reservation or fails to complete the booking.
10.8. For all form of bookings, you must make payment within the specified time limit. If the payment is not made, then Tahira Asia reserves the right to cancel all bookings.
11. CANCELLATION POLICY AND REFUND ELIGIBILITY
11.1. By making a booking, order, or reservation through the Site, you accept and agree to the terms and conditions, including policies regarding cancellation and/or absence, or your specific requests which may be given to Tahira Asia.
11.2. Users may cancel bookings made through Halal Holidays under the following circumstances:
11.2.1. Tahira Asia cancellation policy allows for cancellations,
11.2.2. User requests cancellation within the time frame specified in the policy,
11.2.3. The booking is eligible for cancellation based on the terms and conditions of the package.
11.3. Users must submit a cancellation request through their Halal Holidays account or contact customer support to initiate the cancellation process to include Booking reference number, Reason for cancellation, Any supporting documentation or evidence.
11.4. For any other cancellations, subject to any applicable rights you may have at law, as well as Tahira Asia’s and the Vendor’s policy, Tahira Asia will first investigate and verify applicable booking prior to providing refunds of the same amount paid by you, less any applicable costs incurred by Tahira Asia, including however not limited to processing and administrative surcharges, inter-bank transfer fees, credit card fees etc. (“Refund Amount”).
11.5. Tahira Asia will work with you to refund amounts already paid by you, reduced by the reasonable administrative costs and applicable fee incurred by Tahira Asia (e.g., inter-bank transfer fees).
11.6. Refunds will be processed within 30 days of receiving a valid refund request. The time taken for the refund to reflect in the user’s account may vary depending on the payment method and financial institution.
12. RIGHTS TO USER CONTENT
12.1. By completing a booking, you consent to receiving emails inviting you to provide reviews. Halal Holidays reserves the right to display your review, including comments and your name, at its sole discretion.
12.2. When providing a review, you affirm that you own all rights to the content, granting Halal Holidays a perpetual, worldwide license to use it. You ensure the accuracy of the review, compliance with laws, and absence of third-party rights infringement or harm.
12.3. You are solely responsible for the content of your reviews, which are not treated as confidential by Halal Holidays. Halal Holidays may edit, remove, or modify reviews as it deems fit without obligation to pay or attribute to authors or third parties.
12.4. You agree that your reviews may be used by Halal Holidays without attribution on derivative works, and you waive all rights and claims to the reviews’ content.
13. INTELECTUAL PROPERTY RIGHTS
13.1. Tahira Asia and its affiliated companies, as well as vendors, third parties, or licensors with commercial arrangements, hold all intellectual property (IP) rights in the content on the site, including but not limited to copyrights, patents, trademarks, and logos. In the event of any dispute to Intellectual Properties, Tahira Asia shall have absolute discretion, with justification, to declare ownership of the related IP.
13.2. Content on the Site, comprising software, text, graphics, and other materials, is strictly prohibited from being published, modified, copied, or reproduced outside the site without express written permission from us. Violations may result in civil claims or criminal offenses.
13.3. Except as explicitly outlined in the terms, users are not granted any license or rights to use, possess, distribute, or modify our intellectual property. Third-party intellectual property on the site does not imply endorsement or sponsorship by Tahira Asia.
13.4. Tahira Asia holding property rights over its selection, arrangement, and original content. Users must obtain written consent before modifying, reproducing, or exploiting any part of the content.
13.5. If there is evidence of intellectual property rights violations, the complainant must provide specific details in a notice, including their name and address, evidence of violations, and a statement of good faith recognition. The complainant agrees to subject to Malaysia law and to resolve disputes through mediation. Tahira Asia reviews and handles notifications accordingly and is not liable for losses due to fraud or false accusations.
13.6. You agree to not hold Tahira Asia responsible for losses or damages that may occur as a result of fraud, forgery or false accusations of intellectual property rights infringement.
14. LIMITATION OF LIABILITY
14.1. You acknowledge that the services and content provided on the site are offered “as is” and “as available,” with no express or implied guarantees or warranties, including suitability for a particular purpose, and we disclaim any liability for non-performance or breaches.
14.2. We do not guarantee uninterrupted, error-free functioning of site features, services, or security measures, nor do we ensure that the site or its server are free from viruses or harmful components. We also do not warrant the accuracy, authenticity, integrity, or quality of content, sites, or resources linked from the site.
14.3. We are not liable for any losses or damages resulting from your lack of valid travel permits, and you agree that any material obtained through the services is at your own risk, including potential damage to your computer system or loss of data.
14.4. We expressly disclaim liability for any losses or damages arising from your use of the site or linked sites, including special, incidental, punitive, or consequential damages, except where prohibited by applicable law.
14.5. Nothing in these terms limits a party’s liability for negligence, fraud, or liability that cannot be limited under applicable law. You agree to indemnify us against any claims arising from your use of the site and acknowledge that our only available remedy is termination of your Site use.
14.6. You agree to indemnify and hold harmless Tahira Asia, its employees, affiliates, staff, and partners from any claims, demands, liability, or loss arising from your use of the Site, content accessed through the Site, violation of terms, other rights or obligations, or any act or omission by you. Your only available remedy in such cases is the termination of your use of the Site.
14.7. The Site may provide links to third-party websites but does not control their content or activities. You release Tahira Asia from any liabilities, expenses, or damages resulting from the use of such third-party content or sites. Tahira Asia reserves the right to change or discontinue the Site at any time without prior notice, and termination does not affect existing obligations under the Terms.
15. GOVERNING LAW
These Terms (and any and all disputes arising out of or in connection with these Terms (including any alleged breach or challenge to the validity or enforcement of these Terms)) shall be governed by and interpreted in accordance solely with the Laws of Malaysia.
16. DISPUTES RESOLUTION
16.1. In the event of a dispute, both parties shall negotiate in good faith to resolve the issues for a period of sixty (60) consecutive days. If it is still unresolved, both parties may mutually appoint a sole arbitrator to decide the matter based on evidence and facts. The decision of the arbitrator shall be final. Aggrieve party may pursue an appeal in the Malaysian courts having jurisdiction unless mutually agreed otherwise on other specific jurisdictions.
16.2. These Terms represent the complete understanding between you and Tahira Asia, replacing all prior agreements, whether verbal or written, regarding the subject matter.
16.3. These Terms are drawn up in English, and any translation into another language is for convenience only; in case of conflict between the English version and any translation, the English version prevails. Headings are for convenience and do not affect interpretation; if any provision is deemed unenforceable, it shall still be enforced to the fullest extent permitted by law, and failure to enforce any provision does not constitute a waiver of rights.
16.4. When utilizing the Site for a third party, you are accountable for the accuracy of information provided and must inform them of relevant terms. You agree to indemnify Tahira Asia for any liabilities resulting from breaches by you or the third party.
16.5. You may not assign your rights or obligations without prior written consent. Tahira Asia reserves the right to amend these Terms, with notice given on the Site. No third-party rights are conferred unless expressly stated.
17. MAJEURE
17.1. Tahira Asia is not liable for any failure to fulfill these Terms or breaches, including transaction failures or site restrictions, or any damage or harm to users caused by any act or condition beyond the reasonable control of either you or us due to Force Majeure Event.
17.2. Force Majeure Events, not limited to natural disaster (floods, earthquakes), epidemic, riot, a declaration of war, war, military action, terrorist action, embargo, sanctions, changes in laws or regulations, lightning, hurricanes / typhoons / cyclones, labor strikes, demonstrations, airline or hotel bankruptcy or insolvency, and cyber-attacks, absolve Tahira Asia from liability for any resulting damages or losses incurred by any party.
